On arrival by air or sea: the card is completed for immigration processing, in terms of section 5(2) of the Immigration Act (regulation 9).
Who it applies to, exceptions and limits (full text)
Direction: arrival. Persons and routes: regulation 9 of the Immigration Regulations 2014 (made under section 18 of the Immigration Act) requires every person arriving in Tuvalu by air or by sea, except the crew of commercial aircraft or commercial vessels, to complete an Arrival Card in Form 11 of Schedule 2, in terms of section 5(2) of the Act. The exemption is limited to commercial crew: crew of non-commercial aircraft or vessels, and all other persons, remain covered. Form 11 collects surname, given name, country of birth, date of birth, occupation, country of citizenship, permanent address, gender, passport number, place and dates of issue and expiry, address and phone/email in Tuvalu (non-resident), last port of embarkation, flight number or ship name, purpose of visit (holiday, transit, research/study, business/commerce, government official conference, returning resident, other purpose) and intended length of stay, closing with a signed declaration that the particulars are correct and true in every respect, under the form's warning that a false declaration is a serious offence. Fee: no fee is stated for the card; the card fee is unknown — the $100 in regulation 2(1)(b) (mirrored at regulation 7(h)) is the visitor's permit fee payable by citizens of countries not listed in Schedule 1 of the Regulations, not a card fee. Departure equivalent: regulation 10 requires the same scope of persons departing by air or sea to complete a Departure Card in Form 12; that obligation is not modelled as a procedure here because the record schema's procedure type enum has no departure_card value (see unresolved TV-departure-card-form12-not-modeled).

On arrival, at the baggage examination and clearance stage: the baggage owner attends upon the proper officer and answers questions (regulation 84); a written declaration in customs form C11 or C12 (and C41 if appropriate) is due only if the proper officer requires it, with any duty payable thereon. Reporting (Act s 38) and baggage examination (Act s 40) involve no form by themselves.

Direction: arrival. Core rule — conditional, not universal: regulation 84 of the Customs Regulations (CAP. 26.04.1, 2022 Revised Edition; the 1964 regulations continued in force by section 270 of the Customs Revenue and Border Protection Act, CAP 26.04) provides that the owner of baggage brought into a customs area may be required to make such declaration in writing — in customs form C11 (Passenger’s Baggage Declaration, for passengers arriving by sea) or C12 (International Passenger Baggage Declaration, for passengers arriving by air), and in customs form C41 (Baggage) if appropriate — relating to such baggage as the officer shall require, paying any duty payable thereon and removing the baggage. The condition is a requirement of the proper officer: no arriving passenger owes a written customs form unless the officer requires one. Reporting and examination duties are not declarations: the baggage owner's duty to attend immediately upon the proper officer and answer questions (regulation 84, first limb) is only the prerequisite; the duty of every person arriving to report to a Customs officer or Police station (Act s 38) and the duty to make accompanying baggage available for examination (Act s 40; s 43 is the outbound counterpart) are report and examination duties only — none of them, by itself, constitutes submitting a declaration. Persons: the owner of any baggage brought into a customs area — no crew exemption appears in the captured provisions. Scope of forms: C11/C12/C41 are the only passenger customs forms in the captured current law; the Schedule 4 list of forms contains no departure-side passenger baggage declaration; carrier forms (C4 Ships Report Inwards, C5 General Declaration for Aircraft) and the s 37 inward report are the master's or owner's obligations, not passenger forms. Fee: no amount is captured for the forms; unknown. Duty-free quantities and any cash threshold are not stated in the captured current law (see unresolved TV-duty-free-quantities-not-captured).
