When to apply

Incoming persons: at the latest at the moment the Customs officer can proceed to inspection of baggage brought by travellers; where the competent authority establishes a control zone, before entering the control zone; if no Customs officer is present on the spot, immediately after passage to the nearest Customs officer (Art2(4)). Outgoing persons: at the latest at the moment the Immigration and Border Protection Service police officer proceeds to passport control or, if no passport control takes place, at the latest at the moment Customs can proceed to inspection of travellers' baggage; if no Customs officer is present on the spot, before passage to the nearest Customs officer (Art2(5)). If no Customs officers are present, the declaration is made to the Immigration and Border Protection Service police (Art2(6)). Where transport is by a professional carrier that has not been enabled to declare, the sender declares to the Inspector of Customs at the latest at the moment of the actual entry or exit of the money, precious metals, jewellery or other objects (Art2(3)).

Who it applies to, exceptions and limits (full text)

Art2(1), first sentence, of the Landsverordening melding grensoverschrijdende geldtransporten (CVDR671733, in force 2019-07-31 to present): persons entering or leaving Sint Maarten must declare to Customs officials the money, precious metals, jewellery or other objects of a value of NAf 25,000 or more (inclusive) that they carry with them; 'money' (geld) includes domestic and foreign banknotes, coins and negotiable instruments to bearer (Art1(c)). Second sentence: where incoming or outgoing persons demonstrably travel together and jointly carry money of NAf 20,000 or more (inclusive), the obligations rest on each of them separately (Art2(1) second sentence, Art2(2)); this joint threshold covers only jointly carried money, not precious metals or jewellery, which stay under the individual NAf 25,000 condition. The declaration is made by submitting a form signed by the declarant under the model fixed by the minister (Art2(2)), stating identity and address of the declarant and the owner, the amount, origin and destination, and the reason for the chosen mode of transport (Art3); a ministerial regulation may exempt goods brought in or taken out solely for direct transit (Art2(7)). Currency: under the common Curaçao–Sint Maarten monetary system regulation (CVDR230646) Art18(1)–(2), from the moment of issuance of the Caribbean guilder, references to NAf in legal instruments existing at that moment are read as references to the Caribbean guilder at a one-to-one ratio, and the Sint Maarten Tax Administration confirmed XCG as the official currency from 2025-07-02; no Art18(3) nature-or-purpose exception is known for this law, so the thresholds statutorily equal XCG 25,000 individual / XCG 20,000 jointly carried money for genuinely co-travelling groups — recorded as a legal inference, not a USD conversion — while the currency wording of the current official form remains unverified. Art2(8) obliges the minister to make the form available in paper and electronic form and to enable electronic filing; the current government service page (Ministry: Justice; Department: Customs) lists the MOT form and answers 'Is this service available online? No', which may refer only to the remote web service; neither source overrides the other, and the current state of remote webpage versus border paper or electronic submission remains unverified.
