When to apply

On arrival, at places designated by customs and under cover of an oral declaration (Article 214); where the double circuit is operated — which the Code permits only when circumstances and installations allow (Article 218(2)(b)) — the traveller's choice between green and red circuit itself constitutes the declaration act.

Who it applies to, exceptions and limits (full text)

Under the National Customs Code (Loi n°2018-19 of 27 April 2018) two layers apply to arriving travellers. General layer: traveller and baggage inspection proceeds under cover of an oral declaration ('sous couvert d'une déclaration verbale') and only at places designated by the customs administration (Article 214); Articles 214–222 apply to travellers by any mode of transport (Article 223(1)); a Minister of Finance order may further specify traveller processing (Article 223(2), not obtained). Conditional layer: the 'double circuit' is the simplified customs control system whereby arriving travellers make an act of declaration by choosing between two circuits — green, for travellers carrying no goods exceeding the duty-free admissible quantities or values and nothing prohibited or restricted; red, for all others (Article 1(24)); customs uses the double-circuit system only when circumstances and installations permit (Article 218(2)(b)), so the channel-choice form of the declaration act exists only where the double circuit is actually operated — the Code does not state that any given airport or land border operates the two channels, and that operational fact is not verified here (the channel field is 'conditional' for this reason). Declaration in detail of goods is made in writing, by computer process, or orally where the customs administration so provides (Article 107) — the general goods-declaration regime, not a traveller paper form. Baggage duty-free amounts and values are not stated in the articles read and remain unknown; separately, Article 219 lets returning residents re-import duty-free their previously exported personal effects and private means of transport, and Article 220 grants non-residents temporary admission of their private means of transport for up to one year, renewable, possibly against security. The channel scheme is defined for arrival only; no departure channel scheme is established in the Code, and exit cash reporting follows the regional rules above.
