When to apply

On entry: a person entering the Republic with currency amounting to $10,000 or more (threshold inclusive), or its equivalent in another currency, declares at the time of entry (s 203(1)). On departure: a person leaving the Republic with currency at or above that threshold declares at the time of departure (s 203(1)). The duty arises only when the threshold is met; travellers below it are not required to file. The captured text states no separate deadline, and the medium of the Schedule 1 form is unverified.

Who it applies to, exceptions and limits (full text)

Direction: both entry into and departure from the Republic of the Marshall Islands. A person who enters or leaves the Republic with currency amounting to $10,000 or more, or its equivalent in any other currency, must make a declaration to an authorised officer in the form prescribed in Schedule 1 of the Chapter (s 203(1)). "Currency" is defined broadly (s 202(1)(c)): coin and paper money of the Republic or a foreign country that is legal tender and customarily used as a medium of exchange; monetary instruments exchangeable for money (cheques, travellers cheques, money orders, negotiable instruments); precious metals and precious stones; instruments specified by the Minister of Finance by Order; and currency in electronic form. Failure to declare, or a false declaration, is an offence liable on conviction to a fine not exceeding $50,000 and or forfeiture of the currency under s 210 (s 203(3)). Scope note: the parallel obligation in s 203(2) for currency transmitted out of or received into the Republic by postal services, courier services or transhipment is a separate scenario and is deliberately not covered by this entry. The Schedule 1 prescribed form itself is not attached to the captured official PDF, so the form's name, format and submission channel remain unverified; no fee is prescribed in the captured text. Legal basis: Currency Declaration Act 2009 (P.L. 2009-29, commenced May 11, 2009), as amended by P.L. 2019-101 and P.L. 2020-25 (Nitijela compilation rev. _3).
