When to apply

At entry to or exit from the external CEMAC frontier; the resident re-sale duty applies on entry, and the non-resident origin-proof duty arises at exit and at border checks.

Who it applies to, exceptions and limits (full text)

Regional CEMAC foreign-exchange rule applied in Gabon when a natural person crosses the external CEMAC frontier at entry or exit (Art. 78 'frontières de la CEMAC'; Art. 168 'entrée/sortie de l'espace CEMAC'): cash of a combined value not exceeding CFA 5,000,000 equivalent, foreign currency and CFA francs together, may be held without declaration; any strictly higher cash amount must be declared to the customs services, and the obligation is not satisfied if the information given is incorrect or incomplete. Negotiable instruments and securities covered by the wording 'correspondant à ce seuil' (corresponding to that threshold) are likewise declarable; the article does not fix whether that threshold is inclusive for them. At border checks customs identify the traveller and may require additional information on the origin of funds; unjustified sums are confiscated and remitted to the Central Bank. Residents entering CEMAC must sell the foreign currency they hold to an authorised intermediary. Under Art. 79, non-residents leaving CEMAC may take out foreign currency or other foreign payment instruments up to the amount they declared on entry; with no entry declaration, or when carrying more than they brought in, they must justify the origin of amounts above CFA 5,000,000, failing which the sums are confiscated and remitted to the Central Bank. Art. 77 caps the allocation of travel foreign exchange at the equivalent of CFA 5,000,000 per person per trip, all payment means combined, through authorised intermediaries, which can satisfy duly justified higher requests; it is a purchase allocation, not an absolute export ceiling and not a declaration form. Art. 168 penalises non-declaration to customs of amounts above the authorised threshold on entry to or exit from the CEMAC area, with confiscation of undeclared sums. These provisions do not establish the rules for crossings between CEMAC member states, and no Gabon-specific port form or fee is evidenced in this record.
