At the border post, when crossing the external CEMAC frontier in either direction: declare to customs when cash strictly exceeds CFA 5,000,000 equivalent; art. 79 proof of origin is required of non-residents at exit.
Who it applies to, exceptions and limits (full text)
Regional rule for natural persons crossing the external frontier of CEMAC, on entry or on exit (art. 78): they may hold without declaration cash not exceeding the equivalent of CFA 5,000,000, foreign currencies and CFA francs combined. Any amount strictly above CFA 5,000,000 or the equivalent in foreign currency, together with the negotiable instruments and securities 'correspondant à ce seuil' (corresponding to that threshold; the text does not state whether the threshold amount itself is included), must be declared to the customs services, failing which the sanctions provided for by the regulations in force apply; the declaration obligation is not performed if the information supplied by the person is incorrect or incomplete. During border-post controls the customs services identify the traveller and may, where necessary, require additional information on the origin of the funds; absent justification of origin, the sums are confiscated and remitted to the Central Bank. Resident travellers entering CEMAC must sell the foreign currency they hold to an authorised intermediary. Art. 79 sets a separate obligation for non-resident travellers leaving CEMAC, not an absolute export cap on all travellers: they may take out foreign currency or any other foreign means of payment up to the amount they declared on entry; where no entry declaration was made, or where they take out sums above their own contributions, they must justify the provenance of amounts above CFA 5,000,000, failing which the sums are confiscated and remitted to the Central Bank. Art. 77 caps the traveller foreign-exchange allocation, all payment means combined, at the equivalent of CFA 5,000,000 per person per trip, and duly justified higher needs are met by authorised intermediaries: it is an allocation channel, not a border form and not an absolute export ceiling. These articles govern crossing the external CEMAC frontier; they do not establish the rules for movements between CEMAC member states, and no Congo border form or fee appears in the official texts read in this batch.
